[1/2] Tato část dokumentu představuje rozsáhlou novelu šesti dopravních zákonů, jejímž hlavním cílem je transpozice směrnice (EU) 2023/2661 o inteligentních dopravních systémech (ITS) do českého práva. Klíčovým prvkem je rozšíření a zpřesnění povinností subjektů v silniční, drážní, vodní i letecké dopravě poskytovat bezodkladně aktuální digitální údaje o dopravní infrastruktuře, provozu, parkovištích a přístupových uzlech (zastávky, stanice, přístavy, letiště), které budou zveřejňovány prostřednictvím celostátních informačních systémů spravovaných Ředitelstvím silnic a dálnic nebo Ministerstvem dopravy.

Zákon výslovně stanoví Ředitelství silnic a dálnic s. p. jako správce celostátního dopravního informačního systému a ruší nadbytečnou definici tohoto systému, přičemž rozšiřuje okruh vedených dat v souladu s 27 kategoriemi požadovanými unijním právem. Nově se ukládají povinnosti vlastníkům a správcům pozemních komunikací, provozovatelům drah, přístavů, přístavišť a letišť poskytovat údaje o umístění, přístupnosti a přístupových cestách, přičemž jejich nesplnění je sankcionováno novými skutkovými podstatami přestupků s pokutami až do 100 000 Kč.

Součástí novely je také úprava ochrany osobních údajů, kdy se zavádí povinnost anonymizace nebo pseudonymizace údajů zpracovávaných v rámci ITS, pokud je to technicky možné a účelné. Dokument stanoví postupné nabývání účinnosti jednotlivých ustanovení v letech 2026 a 2028, zejména s ohledem na městské uzly a následné rozšíření na celé území České republiky. Důvodová zpráva detailně odůvodňuje nezbytnost úprav z hlediska práva EU, popisuje dopady na veřejné rozpočty, podnikatelské prostředí a digitální veřejné služby a zdůrazňuje, že novela má převážně pozitivní dopady na transparentnost, dostupnost informací a bezpečnost dopravy.

[2/2] Tato část dokumentu detailně rozpracovává transpozici novely směrnice o inteligentních dopravních systémech (ITS) do několika českých zákonů v oblasti dopravy, zejména zákona o dráhách, o vnitrozemské plavbě, o pozemních komunikacích a o civilním letectví. Klíčovým prvkem je zavedení nové povinnosti provozovatelů drah, přístavů, přístavišť a vybraných letišť poskytovat Ministerstvu dopravy bezodkladně aktuální údaje o umístění dopravních uzlů, jejich přístupnosti (zejména pro osoby s omezenou schopností pohybu a orientace) a o přístupových cestách, přičemž Ministerstvo dopravy má povinnost tyto údaje zveřejňovat prostřednictvím vnitrostátního přístupového místa.

Povinnosti se budou uplatňovat postupně: od 31. prosince 2026 pro dopravní uzly v tzv. městských uzlech (např. Praha, Brno, Ostrava) a od 31. prosince 2028 pro celou dopravní síť EU, vždy pouze u uzlů využívaných pro pravidelnou přepravu osob. Rozsah, strukturu, způsob poskytování i zveřejňování údajů má podrobně stanovit prováděcí vyhláška Ministerstva dopravy, přičemž data musí být dostupná v digitálním strojově čitelném formátu.

V návaznosti na nové informační povinnosti se zavádějí nové skutkové podstaty přestupků za neposkytnutí, neaktualizování nebo opožděné poskytnutí údajů, s jednotnou horní hranicí pokuty do 100 000 Kč; přestupky budou projednávat věcně příslušné správní orgány (Drážní úřad, Státní plavební správa, Úřad pro civilní letectví). Dokument dále vymezuje posuzování souladu se specifikacemi ITS v oblasti pozemních komunikací, které má vykonávat pověřená právnická osoba zřízená Ministerstvem dopravy (předpokládá se Centrum dopravního výzkumu), a odlišuje tento institut od posuzování shody.

Součástí úprav je také promítnutí pravidel ochrany osobních údajů, zejména principů anonymizace a pseudonymizace dle obecného nařízení o ochraně osobních údajů (GDPR), a aktualizace souvisejících právních odkazů. Navržený zákon má nabýt účinnosti dne 1. července 2026, s ohledem na průběh legislativního procesu, přičemž samotné povinnosti poskytování a zveřejňování dat jsou časově navázány na harmonogram stanovený přílohou III směrnice o ITS.

The proposed amendments to the traffic laws primarily regulate road traffic and taxi services. Some of the proposals clarify the rules regarding the weight of vehicle combinations and extend certain rules from highways to selected roads and local roads. Two alternative proposals give municipalities the option to introduce a mandatory professional competence or knowledge test for taxi drivers and to record the results in a registry; one of them explicitly limits the content of the test to only practically necessary knowledge. Another proposal postpones the effective date of the law to December 31, 2026, and the provisions related to data reporting requirements until December 31, 2028.

Proposal 1010

83 - 1010 - Zuzana Ožanová

The amendment only postpones the entry into force of the main law to 31 December 2026, as the passage of the law has been delayed and sufficient legislative time must be maintained. For selected provisions, the delayed entry into force remains unchanged until 31 December 2028. The impact is mainly due to the later start of the obligations to provide traffic data.

Proposal 1040

The amendment gives municipalities the possibility to introduce a local proficiency test for taxi drivers as a condition for offering or providing transport in their territory. The test is to be limited to practical areas such as taxi rules, communication in Czech, orientation around the municipality and working with common technologies; inadequate knowledge unrelated to the performance of the job is explicitly excluded. The proposal also applies to taxi services ordered via apps or intermediaries, while providing an exemption for rides only passing through the municipality. It also introduces a new entry in the register of road transport undertakings indicating that the driver has passed the test.

Proposal 1167

The amendment amends the Road Traffic Act by setting the maximum weight of combinations of vehicles, including cargo, directly in the Act at 40 tonnes. At the same time, the existing regulation is changed so that the decree will no longer determine this overall limit, but only partial values and other technical parameters. The aim is to limit overloading of trucks and the associated damage to roads and risks to traffic safety.

Proposal 1169

The amendment extends the road protection zone for advertising equipment to other major roads, not only motorways. It should also apply to Class I roads, selected multi-lane roads and local roads of Class I and II. The aim is to maintain greater protection and safety on congested roads following the redesignation of the built-up area.

Proposal 1436

Scope: § 21b–§ 34d; pages 1–8.

The amendment restores municipalities’ authority to require taxi drivers to pass a local exam as a condition for offering or providing rides that begin within their territory. The test is intended to assess knowledge of rights and obligations, the Czech language, and local geography; municipalities will be able to determine its content, exemptions, organization, and any applicable fee. The proposal also adds a requirement to record the results of this exam in the Register of Road Transport Operators and stipulates that the municipality must forward the data to the relevant transportation authority. Compared to the situation following the repeal of this authority in 2020, local qualification requirements are thus being reinstated, and violations of these requirements may be subject to a fine of up to 100,000 CZK.

Proposal 1437

Scope: § 21b–§ 34d; pages 1–14.

The amendment gives municipalities the option to require taxi drivers to pass a professional competency exam as a condition for offering or providing transportation services within their jurisdiction. The exam is to be limited solely to practical and relevant knowledge, such as taxi service regulations, consumer protection, communication in Czech or English, navigation within the municipality, and the use of common technologies; conversely, it is not intended to test disproportionate encyclopedic knowledge. The proposal also applies to rides arranged through apps or intermediaries, but does not apply to mere transit through a municipality without picking up additional passengers. At the same time, changes are being made to the Road Transport Register: information regarding the results of this exam will now be included, and the authority of the transport office to record this information is being amended.
