The Act primarily amends the housing support system: it transfers a number of responsibilities from contact points to the Labor Office, repeals certain existing procedures and guidelines, and further digitizes the submission of applications, decision-making, and case management. At the same time, it expands the group of individuals eligible to apply for the registration of a need for support measures, including asylum seekers, recipients of subsidiary protection, and certain foreign nationals with residence permits, and introduces a priority procedure for particularly urgent cases, especially those involving domestic violence, for families with children, and for people experiencing homelessness. Significant changes are being made to housing registries and reporting requirements, while certain provisions and related government regulations are being repealed. Furthermore, the Labor Office’s jurisdiction in the area of housing support is being expanded, and a transitional period is being introduced for entrepreneurs in the field of counseling psychotherapy.

Resolution of the VSR on Parliamentary Print No. 82/0
Processed date: 07.04.2026The Committee on Public Administration and Regional Development recommends that the Chamber of Deputies approve the amendment to the Housing Support Act with the following amendment. It technically modifies the method of proving the integrity of the applicant for a mandate by changing the statutory reference in Section 110(2). Specifically, the reference to §82(3) (first to third sentences) is replaced by a reference to §79(3). This is a legislative and technical clarification of the rules in the housing support system.

The conditions for obtaining support are clarified, including the definition of persons without adequate housing and household income limits. The proposals also regulate administrative procedures, the digitisation of submissions and repeal some previous provisions (e.g. binding opinions or parts of the register). At the same time, it is clarified that selected groups of foreigners, including those with asylum, long-term residence or temporary protection related to the war in Ukraine, may also fall under the system.

Processed date: 04.05.2026This is a resolution of the Guarantee Committee on the amendment to the Housing Support Act, which sets out the order of voting on amendments in the third reading and determines which proposals become non-votable if others are adopted. At the same time, the Committee took positions on the various proposals, recommending some, not recommending some and leaving some without an opinion. The document itself does not substantively change the rules on housing support, but it does organise the further legislative procedure for approving the amendment.

Proposal 636
82 - 636 - Zdeňka Blišťanová
The amendment adds related changes to the Housing Assistance Act and the Uniform Monthly Employer Reporting Act. It introduces a transition period for entrepreneurs providing counselling psychotherapy, who must now have a master’s degree. For those who were already providing these services prior to July 1, 2026, the deadline for meeting this qualification is extended to July 1, 2029. The other amendments are mostly legislative technicalities and the law is to take effect on the day after promulgation.

The amendment fundamentally changes the housing support system by abolishing the binding opinion of the Labour Office and transferring the assessment of applications entirely to municipal contact points. Instead of the current complex assessment, a new income ceiling is introduced, defined as the household’s subsistence level plus 1.3 times the minimum wage. The law also abolishes certain mechanisms, such as the calculation of future housing costs, the regular reassessment of the household’s situation and the criterion of “housing eligibility”, which significantly limited the range of eligible persons. The aim is to reduce the administrative burden and to extend the availability of housing support to working households in housing need.

The amendment fundamentally changes the system of assessing housing support: it abolishes the obligation to obtain a binding opinion from the Labour Office and transfers decision-making and the collection of supporting documents to housing contact points (municipalities with extended competence). Instead of the existing complex conditions, a new income ceiling is introduced, defined as the sum of the household subsistence minimum and the minimum wage. At the same time, some restrictive conditions (e.g. assessing the ’eligibility of the dwelling’ and counting savings) are removed so that more households in housing need can qualify for support. The proposal also repeals related government regulations and modifies data registration and transitional provisions.

The amendment amends the Government’s draft Housing Support Bill to explicitly include foreigners with temporary protection or special long-term residence under the 2022 Act, in particular refugees from Ukraine, among those entitled to receive advice from the contact points. Compared to the original wording, which envisaged only citizens of the Czech Republic and selected other persons, the range of beneficiaries of counselling is thus broadened. These people must have resided, resided, worked or studied in the territory for at least 2 years and be without adequate housing or at risk of losing it. The aim is to prevent them from being exploited on the housing market and falling into housing destitution.

The amendment significantly changes the system for assessing eligibility for housing support measures. It abolishes the compulsory binding opinion of the Labour Office and its regular reassessment of the situation of households and shifts decision-making to housing contact points. The existing assessment mechanism is replaced by a new income ceiling, which is now set at the household’s subsistence level plus 1.5 times the minimum wage, so that working households can also receive support. At the same time, the “housing eligibility” criterion, the counting of savings and related government regulations are abolished, which is intended to simplify administration and widen the range of persons supported.

The amendment fundamentally changes the system of housing support by shifting the main decision-making powers from the contact points to the Labour Office of the Czech Republic, which will now keep records of persons in need of housing and electronic files. It specifies the conditions for inclusion in the register of persons without adequate housing and sets income limits for assessing eligibility. In addition to citizens of the Czech Republic, persons with asylum, subsidiary protection and certain foreigners with long-term residence or the right to equal treatment under EU law may also be eligible for registration. The Act also introduces a vulnerability score, the possibility of increasing support by up to 40%, extends the use of the housing support information system and regulates the control and competences of the Labour Office.

[1/2] Pozměňovací návrh zásadně mění procesní nastavení zákona o podpoře bydlení, zejména přesouvá klíčové rozhodovací pravomoci z kontaktních míst na Úřad práce ČR. Úřad práce nově rozhoduje o zápisu osob do evidence potřebných, o zápisu bytů do evidence i o změnách údajů, provádí šetření bytové situace a vede elektronický spis v informačním systému podpory bydlení. Zákon přesněji vymezuje okruh osob oprávněných k zápisu do evidence, včetně občanů ČR, osob s trvalým pobytem, osob s azylem nebo doplňkovou ochranou a některých cizinců s dlouhodobým pobytem či právem na rovné zacházení podle práva EU. Současně se zavádí jasnější kritéria pro určení osob bez vyhovujícího bydlení, například osoby žijící s pachatelem domácího násilí, domácnosti s příjmem po odečtení nákladů na bydlení nepřevyšujícím životní minimum či osoby v rozvodovém řízení. Posuzování možnosti opatřit si bydlení je nově svázáno s příjmovými limity (např. 1,6násobek životního minima domácnosti, případně trojnásobek u některých zranitelných skupin). Návrh zároveň ruší celý systém závazného stanoviska Úřadu práce a několik dalších ustanovení (např. §§18–21), zjednodušuje postupy, rozšiřuje elektronickou komunikaci a upravuje evidenci bytů včetně podmínek jejich zápisu či výmazu. Součástí změn jsou také přechodná ustanovení, rozšíření kompetencí Úřadu práce v souvisejícím zákoně a odklad účinnosti novely na 1. září 2026.
[2/2] Tato část zákona upravuje postupy pro vydávání potvrzení souvisejících s podporou bydlení a významně mění příslušnost orgánů veřejné správy. Pravomoc vydávat potvrzení o rozšířené využitelnosti bytu a potvrzení o navýšení příspěvků se přesouvá z kontaktních míst na Úřad práce. Potvrzení o rozšířené využitelnosti bytu může být vydáno pouze tehdy, pokud v seznamu potřebných osob v daném správním obvodu není evidována žádná zvlášť zranitelná osoba nebo domácnost, pro kterou by byl daný byt vhodný. Zákon zároveň stanoví systém bodového hodnocení zvláštní zranitelnosti osob, přičemž každý evidovaný údaj o příslušnosti ke skupině zranitelných osob přináší jeden bod a duplicitní údaje v rámci jedné domácnosti se započítávají pouze jednou. Na základě tohoto hodnocení může Úřad práce vydat potvrzení pro navýšení příspěvku na bytové podpůrné opatření nebo asistenci o 20 % či 40 %, zejména u osob s vysokou mírou zranitelnosti, například u osob se závažnou duševní poruchou nebo osob bez střechy nad hlavou.
Další ustanovení upravují kontrolu poskytování podpůrných opatření a evidenci údajů v informačním systému podpory bydlení. Povinnost provádět kontrolu zůstává kontaktním místům, avšak ruší se povinná minimální frekvence jednou ročně. Úřad práce může kontrolovat i správnost údajů o bytech v evidenci, přičemž kontrolovanou osobou je nově poskytovatel, který požádal o zápis bytu do evidence, nikoli pouze ten, kdo plánuje poskytovat podpůrné opatření. Informační systém podpory bydlení je definován jako informační systém veřejné správy, jehož správcem se nově stává Ministerstvo práce a sociálních věcí namísto obecně označeného ministerstva. Evidence obsahuje rozsáhlé údaje o potřebných osobách, bytech i poskytovatelích, přičemž některé dříve evidované údaje (například odhad výše sociální dávky) se ruší a některé formulace se zpřesňují.
Zákon dále stanoví pravidla přístupu k evidenci a veřejné dostupnosti vybraných údajů o poskytovatelích podpůrných opatření. Podání podle zákona se mají standardně provádět prostřednictvím informačního systému podpory bydlení a některá rozhodnutí mohou být vydána bez předchozího úkonu správního orgánu pouze na základě předložených podkladů nebo údajů z informačních systémů ministerstva. Proti vybraným rozhodnutím není přípustné odvolání, přičemž se ruší dřívější výjimka týkající se rozhodnutí o neodůvodnitelné zátěži systému. Zákon také zavádí přechodné období do konce roku 2029, během něhož se některé úkony dočasně neprovádějí prostřednictvím informačního systému podpory bydlení a mohou být činěny jinými způsoby. Současně se ruší dřívější přechodná ustanovení o provozovateli systému a odstraňuje se příloha se seznamem kontaktních míst.
Součástí novely je také změna zákona o Úřadu práce České republiky, která výslovně doplňuje podporu bydlení mezi oblasti jeho působnosti. Úřad práce tak získává nové kompetence v oblasti administrace podpory bydlení a využívá k tomu Jednotný informační systém práce a sociálních věcí, který slouží ke sdílení a správě dat potřebných pro poskytování sociálních dávek a dalších forem podpory.

The amendment eases the conditions for entry into the housing support system by increasing the income limit for the approval of the Labour Office from 1.43 times to twice the minimum subsistence level. At the same time, the threshold for eligible housing costs is increased from the 75th to the 85th percentile of rent. The Ministry of Labour and Social Affairs is now to announce the relevant amounts annually and the government’s authority to change these parameters by regulation and related government regulations is removed. The draft also introduces transitional provisions and provides for the main changes to take effect from 1 July 2026.

The amendment modifies the position of municipal districts and urban districts in the provision of housing support. For the purposes of the Act, municipalities or districts that are entrusted with a dwelling will be regarded as the owners of the dwelling. At the same time, they may be directly mandated to provide housing support measures and will be treated in proceedings in a similar way to independent municipalities. The aim is to simplify administration, allow for separate accounting of contributions and avoid problems where mistakes by one borough affect the whole city.

The amendment adds a new provision to the Housing Support Act on organisational requirements for housing contact points. Municipalities with extended powers will be obliged to ensure the continuous improvement of the qualifications of officials providing services there. The Ministry of Regional Development will be empowered to establish by decree further qualification requirements, the scope of training, minimum office hours and other organisational and technical conditions. The aim is to unify and improve the quality of housing advice throughout the country.

The amendment modifies the income limit for the issuance of a consent binding opinion by the Labour Office in the context of housing support. The current range of 1.3-1.6 times the minimum subsistence level is changed so that it can be set up to 2.0 times. The aim is to widen access to advice and support for vulnerable groups (e.g. single parents, the elderly, people with disabilities or victims of domestic violence) and to strengthen the preventive role of the law in preventing housing distress.

The amendment raises the income threshold for assessing whether a household can provide its own housing from 1.6 times to twice the household’s subsistence minimum. This widens the range of people who can be considered as not being able to secure their own housing and receive support under the housing support system. The modification follows another amendment which simultaneously repeals certain provisions of the Act and changes the construction of the assessment of entitlement. The aim is to make assistance more accessible to households at risk of housing need who would not qualify for assistance under the lower threshold.

The amendment expands the exceptions to the rule that an applicant for housing assistance cannot be re-enrolled if he or she has terminated it by agreement or for his or her own reasons within the last two years. It will now be possible to grant exemptions not only for health reasons but also in other cases of special consideration, provided that they are justified in writing and approved by the head of the contact point. The aim is to enable assistance, for example, for victims of domestic violence or people leaving institutions. This change is due to take effect on 1 July 2026.

The amendment removes two points of the government amendment that would have narrowed the circle of persons entitled to housing counselling. The aim is to maintain a broader target group so that the advice can continue to act as a preventive tool against households falling into housing distress. The authors argue that a narrowing would significantly reduce the availability of assistance and limit the preventive effect of the service. Paradoxically, according to their analysis, it would also lead to lower long-term savings for public budgets.

The amendment stipulates that all municipal offices of municipalities with extended jurisdiction (205 in total) will be housing contact points, instead of the current system where only some municipalities were designated and others were designated by the government by decree. The Annex to the Act listing these municipalities and the Government’s power to designate additional contact points is therefore repealed, as is the relevant Government Order. The aim is to improve the availability of assistance to people in housing need throughout the country. The change is due to come into effect from 1 January 2027 and the ongoing procedure will complete the original contact points.

The amendment extends the range of persons who can benefit from housing advice at contact points. It now explicitly includes persons with temporary protection or special long-term residence under a law adopted in connection with the war in Ukraine. The aim is to enable refugees from Ukraine to access counselling in order to prevent them from being exploited in the housing market or falling into housing distress. At the same time, the wording of the provision is modified by deleting the original phrase ’the Republic or’ and the list of eligible persons is clarified.

The amendment amends the income test for the granting of the housing support allowance. The new requirement is that at least half of the subsistence minimum remains after the household has paid its housing costs, whereas previously the full subsistence equivalent was required. The lowering of the threshold is intended to enable the inclusion of the poorest and most vulnerable households who would otherwise not qualify for support. The aim is to better meet the purpose of the Act - reducing housing need.

The amendment modifies the proposed changes to the Housing Support Act so that the so-called criterion of the applicability of the apartment is completely abolished. The condition that households must have at least the minimum subsistence amount remaining after paying the housing costs in order to be eligible for support is now abolished. The aim is to allow the poorest and most vulnerable households, who would otherwise be excluded from the programme, to access support. The proposal also makes related technical adjustments to paragraph references and recorded data.

The amendment extends the conditions for the granting of the housing allowance. The allowance may now also be granted to persons in an extremely urgent situation under Section 17a(1) without having to meet the standard conditions attached to state social assistance benefits. The amendment changes the wording of the law so that, in addition to the existing condition, there is an additional alternative for granting the aid. The aim is to make it easier and quicker to help people in the most acutely vulnerable situations.

The amendment strengthens the protection of persons in housing need in the housing support system. The Labour Office is now to assess in particularly urgent cases whether assistance is necessary to maintain housing and to inform the applicant of this possibility. At the same time, the deadlines for submitting a new contract for assistance are extended (from 3 to 4 months and from 1 to 3 months) and an exception is introduced if the contract cannot be delivered for reasons outside the supported person. The aim is to prevent unreasonably rapid termination of tenancies and to stabilise the situation of vulnerable households.

The amendment introduces a new provision requiring the Labour Office to process applications for housing support measures in acute social situations as a matter of priority. This applies in particular to victims of domestic violence, households with dependent children at risk of losing their housing, homeless people and people leaving institutions (e.g. children’s homes, social services or prisons) without secure housing. The aim is to avoid serious social impacts caused by delays in decision-making. The proposal also allows these situations to be substantiated by various certificates or affidavits.

The amendment modifies the rules on appeals in the housing support system. The previous provision excluded appeals against selected decisions; an exception is now introduced to allow appeals against decisions to refuse to register the need for a support measure or to not extend it. The goal is to maintain a speedy process while giving applicants a basic appeal remedy in decisions that determine their access to housing assistance.

The amendment modifies the rules for the provision of an allowance for assistance in the housing support system. It now allows, in exceptional cases, to draw assistance for up to 3 years instead of the current limit of 2 years and stipulates that the total period of drawdown may not exceed 3 years over 8 consecutive years. The change is reflected in several provisions of the Act, which regulate the conditions for granting and extending the allowance and introduce a new limitation through Section 91(3). Technical legislative changes to references and wording are also included.
