Summary

The amendment to the Water Act introduces a uniform legal framework for systems of domestic wastewater treatment plants for up to 50 equivalent inhabitants, especially in smaller municipalities. It establishes clear rules for ownership, operation and the obligation of a professionally qualified person and regulates the rights of access to other people’s land during maintenance or breakdowns. It also extends state supervision and introduces new penalties, including fines of up to CZK 500 000 for operating without professional competence. The aim is to increase the protection of the water environment and the long-term sustainability of these systems.

The government has taken a disapproving position on the MPs’ draft amendment to the Water Act regulating systems of domestic wastewater treatment plants. It states that the proposal is legally unclear, difficult to apply and contains flawed definitions of ownership, operation and access to land. It also criticises logical inconsistencies in the determination of the operator and redundant or vague contractual arrangements. The Government recommends that regulation should await the EU implementing acts for the Urban Waste Water Treatment Directive.
