Document 74 - Amendment to the Act on the Prevention of Environmental Damage and its Remediation

Published date: 14.01.2026 |Processed date: 14.01.2026 |Session 10

Summary

The amendment refines the definition of ecological damage, especially for water and biodiversity, to make the law more applicable in practice and clearly distinguish it from other environmental legislation. It strengthens the procedural rules for the imposition of preventive and remedial measures, including the possibility of state intervention and funding from the Fund if the originator is unknown. It introduces mandatory reporting and recording of risk assessments of operators and expands the range of offences and the level of penalties. It also unifies the remit of the Czech Environmental Inspectorate and clarifies the role of expert nature protection bodies.

The document contains the government’s dissenting opinion on the MPs’ draft amendment to the Act on the Prevention of Ecological Damage. The government considers the proposal to be redundant, increasing bureaucracy and not bringing a fundamental qualitative change compared to the existing legislation, which is already in line with EU law. It also warns of increased costs for the state budget and administrative burdens for businesses.
