Summary

The Act transposes EU Directive 2024/1799 and introduces a new obligation for manufacturers, or where applicable importers or distributors, to repair selected products even after the expiry of the statutory warranty period, provided that EU repairability requirements have been laid down for them. Manufacturers may not refuse a repair solely because it was previously carried out elsewhere and must ensure that the repair is provided within a reasonable time and at a reasonable price, while being obliged to ensure the availability of spare parts, information and tools necessary for repairs. At the same time, the Act prohibits technical, contractual or software-based restrictions on repairs and supports the involvement of independent repairers.

Consumers are granted the right to request a European repair information form, which transparently sets out in advance the price, duration and conditions of the repair and is binding on the repairer for at least 30 days; if the repairer does not inform the consumer of the price of diagnostics in advance, it is deemed to be free of charge. The legislation further introduces a European online repair platform with free access for consumers, intended to facilitate the search for repair services and support the circular economy. Supervision of compliance with the obligations is entrusted to the Czech Trade Inspection Authority, and breaches of key obligations may result in sanctions of up to CZK 5,000,000, with the Act entering into force on 31 July 2026.

[1/2] Zákon zavádí novou povinnost výrobců opravovat vybrané druhy výrobků (např. pračky, ledničky, mobilní telefony) i po uplynutí zákonné odpovědnosti, pokud jsou pro ně v EU stanoveny požadavky na opravitelnost. Výrobce nesmí opravu odmítnout jen proto, že výrobek byl dříve opravován jinde, a musí ji provést v přiměřené době a za přiměřenou cenu.

Spotřebitelé získávají právo požádat o evropský informační formulář o opravě, který transparentně stanoví cenu, dobu opravy a další podmínky; pokud je formulář vydán, jsou tyto podmínky pro opraváře závazné nejméně 30 dní. Neinformuje-li opravář předem o ceně diagnostiky, považuje se diagnostika za bezplatnou.

Zákon dále zakazuje technická nebo smluvní omezení oprav, podporuje využívání nezávislých opravářů a zavádí evropskou online platformu pro opravy s bezplatným přístupem pro spotřebitele. Dozor vykonává Česká obchodní inspekce a za porušení klíčových povinností hrozí pokuty až do 5 000 000 Kč. Účinnost zákona je stanovena na 31. července 2026.

[2/2] Navrhovaná právní úprava transponuje směrnici EU 2024/1799 a zavádí povinnost výrobců (případně dovozců či distributorů) opravovat vybrané výrobky i po uplynutí zákonné záruční doby, pokud jde o vady, na které se již nevztahuje reklamace. Cílem je prodloužit životnost výrobků, snížit množství odpadu a výrazně omezit emise CO2 v rámci podpory cirkulární ekonomiky.

Výrobci musí zajistit dostupnost náhradních dílů, informací a nástrojů k opravám za přiměřené ceny a nesmí opravám bránit technickými či softwarovými omezeními. Spotřebitelé získávají právo požádat o opravu a transparentní informace o cenách a podmínkách oprav, včetně možnosti využít evropský informační formulář o opravě.

Zákon zavádí evropskou online platformu pro opravy, dozor České obchodní inspekce a sankce až 5 milionů Kč za porušení povinností, například za odmítnutí opravy nebo neplnění informačních povinností. Účinnost zákona je stanovena na 31. července 2026 v souladu s právem EU a očekává se jeho celkově pozitivní dopad na životní prostředí bez negativních vlivů na soukromí, rodiny či bezpečnost státu.

The Economic Committee of the Chamber of Deputies suspended the discussion of the government’s bill on obligations related to the repair of products (the so-called right to repair). At the same time, it has set a timetable for further consideration, including a deadline for the submission of written amendments by 5 May 2026 and the submission of summary material by the Ministry by 12 May 2026. The actual discussion of the proposal in the Committee is scheduled for 14 May 2026. The document therefore only modifies the procedure and timetable for consideration of the Bill.

The Economic Committee recommends that the Chamber of Deputies approve the bill on product repair obligations as amended. The amendment substantively adds a footnote to the new EU Delegated Directive of 2026, which extends the scope of the products concerned to include local household heaters. At the same time, the Committee authorises the rapporteur to make legislative technical amendments without affecting the content of the law.

The amendment to the Product Repairs Act primarily supplements and clarifies the reference to European regulations, including, for the first time, the 2026 Commission Directive expanding the scope of products to include local household heaters. At the same time, it proposes a change to the effective date of the Act: instead of a fixed date, the Act is now to take effect on the first day of the month following its promulgation. No motion to reject the Act was filed.
