Summary

The law establishes a central digital contact and information point that unifies processes for obtaining information, permits, and coordination of construction work in building gigabit networks, significantly accelerating and reducing the cost of construction. It introduces an obligation for operators and public institutions to record data on existing and planned infrastructure in digital technical maps and other registries, and imposes high penalties of up to 10 million CZK for non-compliance with these obligations. A key change is the automatic approval of a project after 60 days of administrative inactivity, which significantly shortens approval processes and reduces the risk of delays.

The law also adjusts the procedural framework for granting permits directly by law, their subsequent review, and the limitation of appeals. It strengthens the role of the Czech Telecommunication Office (ČTÚ) in resolving disputes over access to physical infrastructure, pricing, and contract modifications, setting fixed deadlines and enabling amicable settlements. At the same time, it expands the obligations of builders regarding the installation of optical infrastructure in buildings and clarifies conditions for registering easements in the land registry, including special exemptions for heritage-protected or security-sensitive properties.

Energy infrastructure is protected through binding opinions from the Energy Regulatory Office, and the law introduces new offenses and fines for violations of the rules. It also repeals the previous legal regulation (Act No. 194/2017 Coll.) and ensures alignment with the European regulation on gigabit infrastructure as well as the ongoing digitalization of construction permitting processes.

[1/2] Zákon zavádí jednotné digitální kontaktní a informační místo pro rychlejší a levnější budování gigabitových sítí, které sjednocuje postupy pro získávání informací, povolení a koordinaci stavebních prací. Posiluje transparentnost tím, že ukládá operátorům a veřejným subjektům povinnost zapisovat informace o existující a plánované infrastruktuře do digitálních technických map a dalších evidencí. Zásadně zrychluje povolovací procesy – pokud úřad nerozhodne do 60 dnů, považuje se záměr automaticky za povolený, čímž se minimalizují průtahy. Zákon také stanovuje pravidla pro sdílení infrastruktury, výjimky z bezpečnostních důvodů a zavádí vysoké sankce až do 10 milionů Kč za nesplnění povinností.

Zákon ruší dřívější právní úpravu (zákon č. 194/2017 Sb.) a plně adaptuje nové evropské nařízení o gigabitové infrastruktuře, přičemž klade důraz na digitalizaci stavebních procesů a zapojení více státních orgánů. Současně stanoví přechodná období pro úpravu informačních systémů a přesun dosavadních evidencí do nového režimu.

[2/2] Text zavádí detailní procesní pravidla pro případy, kdy povolení ke stavbě sítí velmi vysoké kapacity vzniká přímo ze zákona při nečinnosti úřadů, a stanoví možnosti jeho následného přezkumu i omezení opravných prostředků. Zpřesňuje se dokumentace pro zápisy služebností do katastru nemovitostí a rozšiřují se povinnosti stavebníků ohledně vybavení nových či renovovaných budov optickou infrastrukturou, s výjimkami pro památkově chráněné a bezpečnostně citlivé objekty. ČTÚ získává rozsáhlé kompetence při řešení sporů o přístup k fyzické infrastruktuře, cenové podmínky a změny smluv, s pevnými lhůtami pro rozhodování a možností smírného řešení. Současně se posiluje ochrana energetické infrastruktury prostřednictvím závazných stanovisek Energetického regulačního úřadu a stanoví se nové přestupky a pokuty za porušení povinností. Zákon rovněž ruší dosavadní úpravu zákona č. 194/2017 Sb. a zajišťuje návaznosti v digitalizaci stavebního řízení a datových systémů.

The Economic Committee of the Chamber of Deputies has suspended the discussion of the government’s bill on reducing the costs of deploying electronic communications networks with very high capacity. At the same time, it set a timetable for further discussion. The amendments are to be submitted by 5 May 2026, and the Ministry of Industry and Trade will prepare their summary material by 12 May 2026.

The Economic Committee recommends that the law be approved with modifications that specify which short and on-site technical infrastructure structures are covered by the simplified regime. The draft also regulates the review of automatically generated permits: it introduces a five-day period for informing the applicant, limits the review to the party’s complaint and sets time limits of 15 days for the complaint and 2 months for the decision. At the same time, it explicitly maintains the requirements for conservation, environmental and preservation opinions, although the construction regime is otherwise simplified.

The amendment clarifies the government’s proposal regarding the construction of very high-capacity networks, particularly with regard to the scope of construction work, automated permitting processes, and the review of decisions. The definition of the affected structures is being amended: instead of a reference to the annex to the Building Act, the amendment now explicitly lists short technical infrastructure structures up to 100 meters in length and infrastructure within enclosed production facilities, as well as, for the first time, distribution and storage facilities. Furthermore, the deadlines and conditions for review are clarified, including a five-day deadline for sending the certificate, limiting the review to cases initiated by a participant, and a two-month final deadline after which the project proposal can no longer be challenged. At the same time, the proposal explicitly retains requirements for historic preservation, environmental impact assessments, and permits in protected zones, and adds a rule for the allocation of costs associated with the coordination of construction work.

The amendment clarifies the exceptions for construction work of limited scope in the Act on the Deployment of Ultra-High-Capacity Networks. Distribution is now explicitly added to the exceptions, so that they also apply to enclosed facilities used for electricity distribution, not just for generation and storage. At the same time, the existing reference to work under the annex to the Building Act is amended to provide a more specific definition of such work, particularly regarding technical infrastructure up to 100 meters in length, within enclosed non-public premises, and during emergencies. The result is a clearer determination of when certain information and coordination obligations under the Gigabit Infrastructure Regulation do not apply.

The amendment clarifies Section 6 of the main law on the coordination of construction work in the development of very high-capacity networks. It now explicitly includes not only the costs of coordination but also the costs of the actual work itself, and establishes a default rule for their allocation if the parties fail to reach an agreement. Incremental costs are to be borne in full by the applicant, while shared costs for coordination and joint work are to be divided equally among the coordinating parties. The goal is to prevent disputes and provide clearer rules for both practice and the decision-making of the Czech Telecommunications Office (ČTÚ).
