The law comprehensively clarifies the rules for environmental claims, prohibits unverified “green” labels, and imposes an obligation on businesses to substantiate the accuracy of information regarding the sustainability, durability, or carbon neutrality of products. Information obligations are significantly expanded, including the requirement to disclose data on repairability, the availability of spare parts, and the duration of software updates, aiming to increase transparency and reduce consumer deception. At the same time, the list of prohibited unfair practices is expanded, particularly those related to “greenwashing” and premature obsolescence of products.

Consumers gain a new right—if they choose to repair an item, the liability for defects is automatically extended to three years, and sellers are required to actively inform them of this option. The Civil Code is also amended, introducing a harmonized notification of rights concerning defective performance and a mandatory warranty label for product lifespan, thereby standardizing regulations across the EU. The law also abolishes rules related to the now-defunct European online dispute resolution platform.

Supervisory authorities are granted broader powers to verify the accuracy and transparency of business claims, though without increased budgets, which may place greater demands on their capacities. For businesses, this means an increase in administrative obligations and the need to adapt marketing and informational practices to the new European harmonization being implemented by the state to avoid EU sanctions.

[1/2] Zákon výrazně zpřesňuje pravidla proti klamavým environmentálním tvrzením a zakazuje používání neověřených „zelených“ označení či tvrzení o uhlíkové neutralitě založené jen na kompenzacích. Podnikatelé musí poskytovat přesnější informace o životnosti, opravitelnosti, dostupnosti náhradních dílů a délce poskytování softwarových aktualizací, pokud jim tyto údaje poskytne výrobce.

Spotřebitel získává při reklamaci nové právo – pokud zvolí opravu, prodlouží se odpovědnost prodávajícího za vady na tři roky, a prodávající ho na tuto možnost musí aktivně upozornit. Zákon také odstraňuje pravidla související s ukončenou evropskou platformou pro řešení sporů online.

Mění se i občanský zákoník – zavádí povinné harmonizované oznámení o právech z vadného plnění a štítek o záruce za životnost. Povinnosti podnikatelů v oblasti informování spotřebitelů se tak významně rozšiřují a zpřesňují.

[2/2] Sekce popisuje rozsáhlou transpozici směrnic EU zaměřených na ochranu spotřebitele, transparentnost informací a podporu environmentálně udržitelné spotřeby. Zavádí přísnější pravidla pro environmentální tvrzení, povinné harmonizované oznámení a štítky, nové definice (např. životnost, opravitelnost) a rozšiřuje seznam zakázaných nekalých praktik, zejména v oblasti „greenwashingu“ a předčasného zastarávání výrobků.

Podnikatelům vznikají nové informační povinnosti, povinnost ověřovat udržitelnost označení, sdělovat délku poskytování softwarových aktualizací či informovat o opravitelnosti a dostupnosti dílů. Spotřebitelé získají delší garanci při opravě (tříletou odpovědnost), vyšší ochranu proti klamání a jasnější pravidla při nákupu online.

Dozorovým orgánům se rozšiřují kompetence bez navýšení rozpočtů a podnikatelské prostředí očekává zejména zvýšení administrativní zátěže, zatímco stát tímto krokem plní povinnou harmonizaci EU a předchází sankcím.

The Economic Committee of the Chamber of Deputies has suspended consideration of the government’s bill amending the Consumer Protection Act and the Civil Code (Print 53). At the same time, it has set a timetable for further consideration, including a deadline of 5 May 2026 for the submission of written amendments. The Ministry of Industry and Trade is subsequently to submit a summary table with proposals and opinions by 12 May 2026. The actual discussion in committee is scheduled for 14 May 2026.

The amendment adds a transitional provision to the consumer protection amendment: products manufactured or placed on the market by September 27, 2026, will continue to be considered compliant with the new rules on environmental claims and sustainability labeling for a period of 24 months. This is intended to mitigate the immediate impact of the new prohibitions and obligations on businesses with regard to existing products. At the same time, a change to the effective date of the law is proposed, setting it as the first day of the month following its promulgation. No motion to reject the bill was filed.
