[1/2] Tato část dokumentu obsahuje rozsáhlé pozměňovací návrhy k vládní novele zákona o rostlinolékařské péči a současně navrhuje změny řady dalších souvisejících zákonů v oblasti zemědělství, potravin, veterinární správy a státního dozoru. V základní části se upravují povinnosti uživatelů pozemků při ochraně proti škodlivým organismům, rozšiřují se pravidla pro aplikaci přípravků včetně použití bezpilotních letadel (dronů) a zavádí se povinnost minimalizovat zásah pesticidy na pozemky využívané v ekologickém zemědělství. Mění se také systém předávání elektronických záznamů o používání přípravků, kdy nově mají být předávány do konce ledna za předchozích 18 měsíců, přičemž přechodné ustanovení stanoví první období od 1. července 2026 do 31. prosince 2027.

Další části návrhu mění zákon na ochranu zvířat proti týrání (např. rozšíření zákazů při držení psů uvázaných v prostorách domácnosti) a zákon o pojistném na sociální zabezpečení, kde se rozšiřuje sleva na pojistném pro zaměstnance také na práce při pěstování chmele a révy vinné. V zákoně o potravinách se nově ukládá potravinářským podnikům povinnost uchovávat izoláty patogenů z vyšetření zoonóz nejméně jeden rok a na žádost je poskytovat dozorovým orgánům v souvislosti s epidemiologickými šetřeními podle předpisů EU. Rozšiřují se také pravomoci ministerstva měnit či rušit rozhodnutí o potravinách v případě nových vědeckých poznatků nebo bezpečnostních rizik.

Významné změny se dotýkají zákona o zemědělství, kde se upravují údaje evidované o zemědělských podnikatelích včetně údajů o pobytu osob, aktualizace údajů o erozní ohroženosti půdy a pravidla sezónních prací v ovocnářství, zeleninářství, chmelařství a vinohradnictví. Veterinární zákon je doplněn o nové nástroje při výskytu nákaz (např. omezení vstupu do hospodářství s nemocnými zvířaty), pravidla pro kontrolu osvědčení o úlovku u mořských rybolovných produktů a vymezení osob oprávněných provádět ošetření a úpravu kopyt hospodářských zvířat.

Dále se mění zákon o rybářství, plemenářský zákon a zákon o Státní zemědělské a potravinářské inspekci, kde se rozšiřují kontrolní pravomoci inspekce například při podezření na přítomnost psychoaktivních látek v potravinách, při prodeji z automatů nebo při nedodržení hygienických pravidel. Návrh obsahuje také rozsáhlé další poslanecké pozměňovací návrhy, které upravují mimo jiné lesní zákon, myslivost, ochranu zemědělského půdního fondu či pravidla pro ekologické zemědělství. Účinnost většiny ustanovení je stanovena na 1. ledna 2027, zatímco některé části mají nabýt účinnosti dříve – buď po vyhlášení zákona, nebo od 23. srpna 2026.

[2/2] Tato část novely zavádí změny zejména v lesním zákoně, zákoně o myslivosti a zákoně na ochranu zvířat proti týrání. U lesního zákona se upravují definice a postupy státní správy lesů, například je nově vyžadován souhlas orgánu státní správy lesů pro umístění drobných staveb do 30 metrů od okraje lesa. Dále se zpřesňují kompetence orgánů při povolování výjimek z pravidel hospodaření v lese, mění se některé správní postupy a zavádějí se nové přestupky související s oznamovacími povinnostmi při realizaci záměrů v lesích. Novela také upravuje kvalifikační požadavky na pracovníky státní správy lesního hospodářství a stanovuje přechodné ustanovení, podle něhož mohou osoby s alespoň pětiletou praxí tyto činnosti vykonávat i bez nově požadovaného vzdělání do konce roku 2031. V oblasti myslivosti se zavádějí změny týkající se regulace invazních druhů zvěře, zejména siky, rozšiřují se možnosti jejího lovu a upravují se pravidla lovu dalších druhů, například prasete divokého či lišky. Současně se mění pravidla poskytování finančních příspěvků a služeb na myslivecké činnosti, včetně kompetencí ministerstev, krajů a způsobu podávání žádostí. V zákoně na ochranu zvířat proti týrání se doplňuje, že ustanovení o zákazu některých způsobů usmrcování se nevztahují na lov zvěře a regulaci živočichů prováděnou podle zákona o myslivosti.

The amendment modifies the Hunting Act by repealing the authority of gamekeepers to kill stray dogs and cats in hunting grounds; the original provision is therefore deleted. At the same time, the related provisions are amended so that the reporting obligation following killing now applies only to feral domestic animals and marked animals from farm breeding, and the relevant sections of the Act are renumbered. The proposal also narrows the authority of the gamekeeper, who will no longer be permitted to kill dogs, cats, and feral domestic animals. The main objective is to strengthen the protection of domestic animals and limit disproportionate interventions by gamekeepers against dogs and cats.

The amendment extends the range of agricultural entrepreneurs who can use seasonal labour agreements for up to 1 280 hours per year for harvesting fruit and vegetables. Organic farmers who receive subsidies for organic farming, as well as those who are registered in the organic farming system but do not receive subsidies, will now also benefit from this option. The aim is to remove the inequality whereby these farmers were excluded simply for not meeting the minimum area or not drawing production subsidies. The change has no impact on the state budget and makes use of existing registrations.

The amendment modifies the Forestry Act and related regulations in order to reduce the administrative burden and clarify certain procedures of the state forest administration. It introduces the obligation to obtain the consent of the state forest administration authority for small constructions up to 30 m from the forest edge and newly stipulates that certain exemptions (e.g. the size of clear-cutting or reforestation periods) will be granted in an administrative procedure with the possibility of appeal. It removes the prohibition on damaging groomed ski trails in the forest, as well as a planned rule that would have required the Department to set a minimum amount of dead timber in forests. It also regulates the competences of authorities, offences, qualification requirements for officials and certain subsidy and registration mechanisms in forestry.

The amendment amends the Hunting Act and abolishes the authorisation of the hunting guard and the hunting manager to kill stray dogs and cats in hunting grounds that chase game at a distance of more than 200 m from a dwelling. This power is removed from the Act and only the ability to kill animals requiring control or feral farm or farm animals remains. At the same time, the notification requirement is modified - only the killing of feral farm or farmed animals, not dogs or cats, will require notification to the owner. The aim is to strengthen the protection of domestic animals and to reduce the number of cases where they are shot by game wardens.

The amendment modifies the Forest Act and related regulations in order to simplify administration and clarify the powers of state forest administration bodies. It introduces the obligation to obtain the consent of the state forest administration authority for small constructions up to 30 m from the forest edge and unifies the granting of certain exemptions (e.g. the size of the clear-cut or forest regeneration periods) in the standard administrative procedure instead of the current non-administrative procedure. The qualification requirements for forestry officials are simplified and a transitional period for gaining experience is introduced. The proposal also abolishes the planned obligation to set a minimum quantity of dead wood in forests and regulates certain offences, the competences of the authorities and the promotion of afforestation.

It introduces rules to enable its intensive regulation by hunting, extends the powers of game wardens and game managers, allows night hunting with modern optics and simplifies some hunting procedures (e.g. reducing the minimum hunting distance from hunting ground boundaries from 200 to 100 metres). At the same time, the conditions for fee hunting and the procedures of the state administration in case of changes in game numbers in hunting grounds are modified. The proposal also newly regulates the system of financial contributions and state services to support hunting management.

Proposal 872

The amendment introduces a ban on hunting game underground using dogs (so-called nooring) and explicitly includes it among the prohibited methods of killing wild animals under the Act on the Protection of Animals against Cruelty. At the same time, it prohibits the captive breeding of red foxes for the purpose of training hunting dogs and repeals the previous provision of the Hunting Act which allowed such temporary possession of foxes on the basis of a permit from the authorities. Existing permits previously issued for the temporary keeping of foxes remain in force under a transitional provision. The amendments aim to reduce inhumane practices in hunting and training dogs and to strengthen animal protection.

Proposal 873

The amendment calls for the retention of the entire provision of Section 50 of the Forestry Act, which regulates the supreme state supervision in the field of forestry. It rejects the proposal to delete it because it would weaken the supervisory role of the Ministry of the Environment and upset the balance between the productive and protective functions of the forest. According to the reasoning, this is an unsystematic change which is not related to the amendment on plant health care under discussion and interferes with the competences of the ministries. The aim is to maintain the existing state supervision of forest protection.

The amendment calls for the retention of amendment point 109 of Act No. 250/2025 Coll., and thus of Section 33(8) of the Forestry Act. This provision encourages leaving some of the wood in the forest for natural decomposition, which improves the soil, reduces erosion and promotes biodiversity. The proposal highlights that this is a long-established forestry practice and there is agreement between the ministries on the future issuance of an implementing decree. The aim is to avoid the deletion of this provision from the legislation.

The amendment amends the Act on the Protection of the Agricultural Land Fund and regulates the rules for changes to the consent for the withdrawal of agricultural land, particularly in connection with mineral extraction and land reclamation. It now allows, in exceptional cases, to exceed the current limit of 20% of the reclaimed area if the area is to be protected as a specially protected area or a significant landscape feature. It also introduces the new institution of a public law contract, which allows the reclamation plan for smaller quarries (up to 10 ha) to be amended in favour of the protection of the natural values created, while part of the funds must be transferred to the municipality for landscape restoration. At the same time, the rules on registration, the validity of the consent and the cases in which no levy is payable for land withdrawal are clarified.

The amendment modifies the Hunting Act and the Act on the Protection of Animals against Cruelty, mainly due to the inclusion of the Sika deer on the EU list of invasive non-native species. It introduces rules to allow for more intensive regulation of this species - e.g. extending the powers of game wardens and farmers to hunt it, allowing night hunting with equipment and removing some administrative obstacles.
