Summary

The Act comprehensively introduces European extradition and preservation orders for electronic evidence, which will allow Czech authorities to directly request data from digital service providers in the EU, while at the same time establishing the obligation of Czech authorities to receive and execute such orders from other countries. This includes a move to mandatory electronic communication through the e-CODEX system, which significantly digitises judicial cooperation and introduces new technical and organisational requirements for police, prosecutors and courts. Service providers must respond to orders within short deadlines, protect the confidentiality of data and may face penalties of up to 2% of global annual turnover in case of non-compliance.

The law details the jurisdiction of Czech authorities, review processes, remedies and grounds for refusing to comply with orders, including situations involving legal barriers or immunities. Of particular importance is the expeditious retention of data by a specialised police unit due to the risk of its rapid loss, as well as the procedures for non-compliance by the provider or for filing objections. The issuing of Czech warrants abroad, the notification of the persons concerned and the reimbursement of costs to the providers are also regulated, which strengthens the uniformity and speed of criminal justice cooperation across the EU.

[1/2] Navrhovaná úprava zavádí do českého práva evropský vydávací a uchovávací příkaz na elektronické důkazy, které budou přímo vyžadovány od poskytovatelů digitálních služeb v jiných členských státech EU. Zákon zároveň plošně přechází na povinnou elektronickou komunikaci justičních a ústředních orgánů prostřednictvím decentralizovaného informačního systému e‑CODEX, s přesně stanovenými výjimkami. Poskytovatelům služeb vzniká povinnost na příkazy reagovat a za nesplnění hrozí vysoké sankce až do 2 % celosvětového ročního obratu. Nově se detailně upravují příslušnosti orgánů, postupy, opravné prostředky a pravidla přezkumu u těchto evropských příkazů.

Změny významně digitalizují trestní justiční spolupráci v EU, zrychlují přístup k elektronickým důkazům a sjednocují procesy, které dosud probíhaly pomaleji přes klasickou právní pomoc. Zákon také obsahuje rozsáhlé technické a organizační povinnosti pro české justiční a policejní orgány spojené s provozem a integrací systémů pro elektronickou komunikaci.

[2/2] Sekce podrobně upravuje, jak české orgány přijímají, přezkoumávají, uznávají a vykonávají evropské vydávací a uchovávací příkazy týkající se elektronických dat, které vydají jiné členské státy EU. Zavádí se jednotná příslušnost státních zástupců, soudů a specializovaného útvaru Policie ČR pro zajištění dat, včetně přísných lhůt a možnosti odmítnutí výkonu z důvodů uvedených v nařízení (např. imunity, právní překážky). Významnou rolí je urychlené uchování dat přes centrální policejní útvar, protože hrozí jejich rychlá ztráta.

Zákon zavádí proces pro uznání a výkon příkazů, možnost námitek adresáta, soudní přezkum a postupy v situaci, kdy poskytovatel dat nevyhoví. Stanoví rovněž povinnost poskytovatelů a adresátů chránit důvěrnost a integritu dat a umožňuje ukládat vysoké pořádkové pokuty až do 2 % celosvětového obratu poskytovatele.

Upravuje také příslušnost českých orgánů při vydávání vlastních evropských příkazů do zahraničí, pravidla informování dotčených osob, náhradu nákladů poskytovatelům a harmonizační termíny spojené s digitalizací justiční spolupráce v EU.

The amendment refines the rules on the European Arrest Warrant and temporary surrender between EU countries to bring Czech law into line with the European Commission’s requirements. It explicitly introduces the possibility of questioning a person in the Czech Republic, including by video conference, if temporary surrender is not allowed, and removes the fixed limit of 10 days for the length of temporary surrender, which is now to be based on an agreement between national authorities. It also sets out the procedure for the waiver of privileges and immunities and speeds up the law’s effectiveness due to the threat of EU proceedings and fines as well as the need for timely operation of the rules on electronic evidence.

Scope: Section 395m; pages 1–3.

The amendment modifies Section 395m such that the fixed minimum retention period for traffic and location data is changed from 6 months to a reference to the period specified in Section 97(3) of the Electronic Communications Act. The aim is to align the provision with any future amendments to that Act and to avoid specifying a specific time limit directly in the Act on International Judicial Cooperation. In practice, this affects the conditions under which service providers may request reimbursement of costs when complying with a European Production Order for electronic evidence.
