Document 286 - Government Bill amending Acts in the area of trade secret protection – EU

Scope: Part One–Part Four; § 1–§ 2990c; pages 1–30.

The bill clarifies the protection of trade secrets under European Union law and extends it to infringements outside the context of economic relations. It now explicitly defines the unauthorized acquisition, disclosure, and use of trade secrets, including products derived therefrom, and protects legitimate conduct, such as freedom of expression or reporting of illegal activity. It introduces specific legal remedies, measures to cease and remedy infringements, rules on damages, and protection of confidential information in case files and judgments. Disputes will be adjudicated by the regional court; the bill is proposed to take effect on January 1, 2027.
