Summary

Scope: Part One–Part Two; § 20; pages 1–6.

The proposal amends the functioning of the national park board in the approval of key conservation and management documents. A representative of the Fire and Rescue Service of the Czech Republic is now required to join the board, and separate voting is introduced, meaning that a proposal must secure a majority among both the delegated representatives and the appointed members. In the event of repeated disagreement, the decision-making authority is transferred to the Ministry of the Environment following prior deliberation by the government, which changes the current procedure. Documents that have already been approved may be reconsidered within two years under specified conditions; the amendment takes effect on January 1, 2027.

The government has taken a negative stance on the parliamentary bill. It states that although the involvement of the Fire and Rescue Service in the national park council may be beneficial, it considers the proposed separate vote and the transfer of decision-making to the ministry following government deliberation to be ill-conceived, unclear, and administratively burdensome. It also criticizes the fact that the bill weakens the unified role of the board and may create legal uncertainty regarding the nature of the ministry’s decision-making. It considers the possibility of reopening already approved documents to be particularly problematic, as this would undermine the legal and economic certainty of national park administration and related acts.
