Summary

The proposal amends the Criminal Code to explicitly punish so-called spiking, i.e. the unauthorised administration of an addictive substance to another person against their will or without their knowledge. It introduces a new offence of “restricting freedom of decision” with higher rates if the offender facilitates another offence, acts with another person or causes serious injury or death. At the same time, for selected drug offences, it explicitly adds that the mere administration of a substance is also punishable. It is to take effect from 1 July 2027.
