Summary

The proposal amends the Competence Act to explicitly extend the remit of the Cabinet Office. The Office of the Government now has a statutory coordination role in the protection of human rights, equal treatment, minority rights, civil society, gender equality including related forms of violence, and inter-ministerial coordination of drug policy. This is mainly a statutory confirmation of the agendas that the Office of the Government already effectively carries out. It is proposed to take effect on 1 January 2027.

The government takes a negative stance on the proposal. It rejects the idea of explicitly expanding the Office of the Government’s jurisdiction in the areas of human rights, equal treatment, minority rights, gender equality, civil society, and drug policy, as it intends to transfer these responsibilities to the relevant ministries. According to the government, the proposal would lead to duplication of efforts and potential conflicts of jurisdiction, and would be inconsistent with the Office of the Government’s role as a support apparatus rather than an interministerial body. The government also states that EU law does not require these responsibilities to be carried out specifically by the Office of the Government and criticizes the proposal for technical legislative shortcomings.
