Document 196 - Amendment to the Act on International Judicial Cooperation in Criminal Matters - EU

The proposal adapts Czech criminal legislation to the EU Regulation on the transfer of criminal proceedings between EU Member States from 1 February 2027. It determines which Czech authorities will decide on the transfer or transfer of proceedings, introduces the rights of the accused, suspect and victim to information and remedies, and allows for videoconference interrogations. At the same time, it clarifies the rules of the European Arrest Warrant, in particular on temporary surrender and immunity, and extends the possibility for Czech authorities to prosecute certain surrendered offences even where Czech criminal jurisdiction would not otherwise be available.
