This document is not a substantive amendment to the bill, but a committee resolution on the further consideration of Chamber of Deputies Document No. 187. The committee suspended the general debate, set a deadline for submitting amendments by June 23, 2026, and requested that the sponsor provide reasoned opinions on these proposals by June 29, 2026. At the same time, it instructed the committee chair to forward the resolution to the Speaker of the Chamber of Deputies. The Committee recommends approving the draft with amendments that primarily adjust the rules for electronic records management systems and defer certain digitization requirements. Exemptions from the mandatory records management certification are now being expanded to include, in addition to security forces and the Military Police, certain municipalities, their organizations, schools, and systems handling classified information, with full compliance deferred until December 31, 2028. At the same time, certain provisions of the Act on the Collection of Laws and eLegislation are postponed from 2027 to 2030, and an informative overview of public law obligations arising from draft legislation is introduced. The bill also clarifies the prohibition on supplying unsuitable filing systems and stipulates that one of the deferred amendments will take effect on January 15, 2027.

The amendment primarily clarifies the postponement and conditions for the digitization of the records management system and eLegislativa, and newly specifies who must have certified electronic systems and who may be exempt from this requirement. It establishes a transition period lasting until the end of 2028, during which the affected authorities are to bring themselves into compliance with the new rules, while also restricting the supply of non-compliant systems. Furthermore, it postpones certain obligations under the Act on the Collection of Laws until 2030 and introduces an informative overview of public law obligations derived from draft legislation. It also includes new provisions regarding basic registries, which allow for the creation of test identities and test data; these must not be interchangeable with real persons and must not give rise to legal effects.

This is a resolution of the Sponsoring Committee regarding an amendment to laws in the area of internal administration; it is not the actual text of the amendment itself. The Committee recommends the order in which the Chamber of Deputies should vote during the third reading on amendments A, B, and C, as well as on the bill as a whole. It issues a favorable opinion on proposals A and C and takes no position on proposal B; at the same time, it authorizes the rapporteur to make any necessary technical legislative amendments in accordance with the Rules of Procedure.

The amendment adds explicit rules to the Act on Basic Registers regarding the creation and use of test identities and test data when testing the functionality, security, and interoperability of public administration systems. It specifies who creates and manages this test data, including the involvement of the Digital and Information Agency, the Population Register, the Foreigners System, and the Register of Persons. It is explicitly stipulated that test data must be distinguishable from actual data, must not be interchangeable with real persons or entities, and cannot give rise to, alter, or terminate rights and obligations. The attached full text also highlights other changes, such as the replacement of certain wording and the change in the legal effect of a decision from the moment of issuance to the moment of delivery to the builder or the obligated party.

The amendment adds explicit rules to the Act on Basic Registers regarding the creation and use of test identities and test data when testing public administration information systems. It newly specifies who may create and manage them, what characteristics they must have, and that they must be clearly distinguished from real persons and data. The proposal also grants the Digital and Information Agency the authority to request their creation in the population register, the foreign nationals system, and the register of persons; this directly affects matters concerning foreign nationals as well. At the same time, the designation of the system administrator in Section 7 is clarified by replacing the full name with the abbreviated designation “Agency,” and it is explicitly confirmed that test data have no legal effect.

The amendment adds explicit provisions to the Act on Basic Registers regarding test identities and test data for the secure testing of state information systems. It newly specifies who may create and manage them, how they must be labeled, and that they must not be interchangeable with real persons or give rise to the creation, modification, or termination of rights and obligations. The proposal also explicitly concerns the population registry, the register of persons, and the information system for foreign nationals, where selected state authorities may request the creation of test data. It also includes a formal change from the full name “Digital and Information Agency” to the abbreviated name “Agency,” and the effective date of this new section is postponed by 12 months.

A new § 4b is introduced, which specifies who may create and manage test identities and data, including a special procedure for the Population Register, the Register of Persons, and the Foreigners Information System. The bill also clearly stipulates that test data must be distinguished from actual data and cannot give rise to, alter, or terminate any rights or obligations. The name “Digital and Information Agency” is also being changed to the abbreviated “Agency,” and the effective date of this new provision is postponed by 12 months from the date of its promulgation.

The amendment modifies the committee’s proposal so that the postponement of part of the eLegislativa system does not result in the deactivation of the so-called “lobbying trail” in the legislative process. It maintains the requirement to include information on lobbying in explanatory memoranda and amendment proposals even during the transitional period when part of the electronic system is not in use. At the same time, it clarifies that the temporary suspension applies only to part of Section 20, not to the provisions on the “lobbyist trail,” and adds corresponding references in the Chamber of Deputies’ Rules of Procedure. In practice, therefore, it corrects the technical postponement so that the transparency of the legislative process is maintained.
