Summary

The proposal amends the Waste Act so that municipalities with very low production of mixed municipal waste have a 10% lower mandatory target for the proportion of separated waste. It responds to situations where municipalities are effectively preventing waste (e.g. through home composting) and yet do not formally meet the legal sorting targets. A new annex is introduced with a formula and per capita limits on the amount of mixed waste that can be used to apply the reduction in the target; these limits will be progressively reduced. The law is proposed to take effect from 1 July 2026.

The government does not agree with the draft amendment to the Waste Act. It states that the problem of municipalities with low production of mixed waste is real, but considers the proposed reduction of sorting targets by a fixed value to be too fundamental a change without sufficient professional and self-governing discussion. The Government believes that the relief could weaken the incentive to sort, encourage formal compliance and does not take into account the different circumstances of individual municipalities.
