The Act amends the rules governing social services and benefits for persons with disabilities, particularly in proceedings concerning care allowances and mobility allowances. It introduces the possibility of mitigating hardship when applying EU rules to care allowances for persons residing in the Czech Republic who do not receive a similar benefit from another EU country, adjusts the obligations of applicants, and transfers certain tasks between the Labor Office and the regional social security administration. The mobility allowance is increasing from CZK 2,900 to CZK 3,000, and authorities will adjust it automatically starting in 2027 without requiring a new application. At the same time, certain earlier changes in related amendments are being repealed or postponed, including the postponement of part of the effective date from July 1, 2026, to June 1, 2028.

They propose to increase the care allowance either across the board in several tiers or significantly only for the highest tier from CZK 27,000 to CZK 40,500 or CZK 54,000, and to increase the mobility allowance from CZK 2,900 to CZK 3,000. At the same time, it provides that the Labour Office will make adjustments automatically without an application, and cancels some of the earlier postponed changes in the 2022 Act.

The Committee recommends the order in which the Chamber of Deputies should vote on the amendments at third reading and expressly supports Proposal B, while taking no position on the other proposals. Proposal 1014
125 - 1014 - Jana Pastuchová
The amendment moves the enhanced mobility allowance for people using home oxygen therapy or pulmonary ventilation from a temporary to a permanent scheme. It also increases the amount from CZK 2 900 to CZK 3 000 per month from 1 January 2027 and stipulates that the Labour Office will automatically adjust the benefit without a new application and without issuing a new decision. The proposal also abolishes earlier provisions under which this special arrangement was to expire over time.

The amendment increases the care allowance for children up to 18 years of age in dependency level IV outside residential social services from CZK 27 000 to CZK 54 000 per month. The change does not affect adults or children in residential services and is intended to help families caring for children with the most severe disabilities at home. It includes transitional rules to allow the Labour Office to adjust the benefit automatically without a request. The effective date is proposed to be January 1, 2027.

The amendment increases the care allowance for persons living outside of residential social services from CZK 27 000 to CZK 40 500 per month for children and adults. It does not change the range of eligible persons or the conditions of entitlement, but only the amount of the benefit for a narrowly defined group of people with the most severe disabilities. At the same time, it introduces transitional rules to allow the Labour Office to increase the benefit automatically even for cases already underway and being paid without a new application. This change is now set to take effect on 1 January 2027.

The amendment doubles the care allowance for stage IV dependency for people outside residential social services from CZK 27 000 to CZK 54 000 per month, for both children and adults. It does not change the range of beneficiaries or the conditions of entitlement, but only increases the benefit for the most severe cases of care in the home environment. At the same time, it introduces transitional rules to allow the Labour Office to increase the benefit automatically even for cases already running and being paid without a new application. This change is proposed to take effect on January 1, 2027.
Proposal 1036

The amendment amends the main text so that the enhanced mobility allowance for people using home oxygen therapy or home lung ventilation is not just extended temporarily but remains permanently. Existing provisions which were intended to end this support in the future are removed, so that it is no longer time-limited. The proposal does not change the amount of the benefit or the range of beneficiaries, but strengthens the legal certainty of the households concerned; the additional costs are not due to be incurred until 2028.

The amendment increases the amounts of the child and adult care allowance from 1 January 2027 to partially restore their purchasing power after inflation. The new amounts are to be adjusted automatically without an application and without issuing a notice, only by an entry in the file. The annual impact on the state budget is estimated at around CZK 1.91 billion.
